General Terms & Conditions - NeoXell Beauty Clinic

Version 1.0 - Effective as of July 1, 2025

These General Terms and Conditions apply to all agreements and services provided by NeoXell Beauty Clinic ("the Clinic"), registered with the KVK under the name of Olena Tykhan, to its clients ("the Client").

Article 1: General

1.1. By booking an appointment at the Clinic, the Client agrees to these General Terms and Conditions.

1.2. The Clinic will perform all treatments to the best of its ability and in accordance with the requirements of good craftsmanship.

1.3. The Clinic will inform the Client about the nature and scope of the treatment, the expected results, and any potential risks.

Article 2: Appointments & Cancellations

2.1. All appointments must be booked in advance.

2.2. The Client must inform the Clinic of any inability to attend an appointment as soon as possible.

2.3. If an appointment is cancelled at least 24 hours in advance, no fee will be charged.

2.4. If an appointment is cancelled less than 24 hours in advance, or in the case of a no-show, the Clinic reserves the right to charge 50% of the scheduled treatment price.

2.5. If the Client is more than 15 minutes late for an appointment, the Clinic may shorten the treatment time to avoid delaying subsequent clients. The full price of the scheduled treatment will still be charged.

Article 3: Prices & Payment

3.1. All prices for treatments and products are stated in Euros (€) and include VAT (BTW).

3.2. The Clinic reserves the right to change prices. Any price changes will be communicated in advance.

3.3. Payment for treatments and products is due in full at the time of the appointment.

3.4. The Clinic accepts payments via PIN (debit card) and cash.

Article 4: Client Obligations

4.1. The Client must provide all necessary information regarding their health, allergies, medication use, and previous treatments that may be relevant to the safe execution of the treatment. This information must be accurate and complete.

4.2. The Client is obligated to follow all pre- and post-treatment care instructions as provided by the Clinic. Failure to do so may affect the results of the treatment and may void any liability of the Clinic.

Article 5: Liability

5.1. The Clinic has a professional liability insurance policy (*bedrijfsaansprakelijkheidsverzekering*).

5.2. The Clinic is not liable for any damages, of any kind, that arise because the Client has provided incorrect or incomplete information as referred to in Article 4.

5.3. The Clinic is not liable for unsatisfactory results if the Client has failed to follow the aftercare instructions.

5.4. Any liability of the Clinic is limited to the amount paid out by its liability insurance for the case in question, plus the amount of the deductible (*eigen risico*) under that policy.

Article 6: Confidentiality

6.1. The Clinic is obligated to maintain the confidentiality of all confidential information shared by the Client during the intake and treatment process, in accordance with GDPR regulations.

6.2. Information is considered confidential if it has been communicated as such by the Client or if it arises from the nature of the information (e.g., medical data).

Article 7: Complaints

7.1. If the Client has a complaint about a treatment or product, they must report it to the Clinic as soon as possible, but no later than seven (7) days after the treatment or purchase.

7.2. The Clinic will seek to find a satisfactory solution in consultation with the Client.

7.3. Submitting a complaint does not release the Client from their payment obligation.

Article 8: Governing Law

8.1. All agreements between the Clinic and the Client are governed by Dutch law.

8.2. Any disputes will be submitted to the competent court in the Netherlands.
